Chinese court thumps Uncle Martian for rip-off

A Chinese court has ruled in favour of Under Armour in its case against Uncle Martian, a Chinese company that emerged last year with logos and sneaker designs copying the US sportswear brand.

As well as ordering Uncle Martian to stop using the contested trademarks, the People’s Higher Court of Fujian Province has ordered the company to destroy all infringing products, pay about US$300,000 in damages, and publish a statement to “eliminate the adverse effect of Uncle Martian’s infringement”.

Representing Under Armour, law firm Finnegan, Henderson, Farabow, Garrett & Dunner says the battle may not be totally over as yet, with the Uncle Martian team appealing the case.

Under Armour filed the $15 million suit against Uncle Martian in June last year and had an injunction in its favour issued in November.
