Philippine discount grocer Dali to stop sale of alleged product rip-offs

Philippine discount grocer Dali has halted the sale of certain in-house condiment brands following allegations of product rip-offs by Nutri-Asia.

The Intellectual Property Office of the Philippines (IPOPhl) ordered Dali to remove three products from its shelves, citing that they were “confusingly similar” to Nutri-Asia’s established brands, including UFC Banana Ketchup, Datu Puti Vinegar, and Datu Puti Soy Sauce.

IPOPhl, however, confirmed that Dali complied with the injunction by removing the products from its stores.

In response to the complaint, Nutri-Asia’s legal representative, Cruz Marcelo, and Tenefrancia law firm filed a case against the grocery chain for trademark infringement, unfair competition, and copyright infringement.

“During the injunction hearings, our legal team has successfully established Nutri-Asia’s IP rights over two of the Philippines’ most popular household brands against Dali,” said the law firm. “The injunction preserves Datu Puti and UFC’s well-established goodwill and reputation.”

Aside from Nutri-Asia, Rappler reported other Dali products that had strong similarities with other brands. 

For example, the grocer has a made-in-Vietnam beer whose packaging is similar to San Miguel’s Red Horse beer; Margie margarine, which resembles Star margarine; Bakakult, which looks like Yakult; and Kingrox, which looks similar to Clorox. 

“We focus on providing the same quality as the leading brand that we intend to replace but with significantly lower cost as the supplier does not need to spend on marketing, promotions, research, etc,” said Dali. 

Hard Discount Philippines is a wholly owned subsidiary of HDPM Sin Pte Ltd, a foreign company incorporated under the laws of Singapore. In March, the company secured a US$25 million investment from Singapore-based equity firm Venturi Partners to fuel expansion plans.
